RECRUITMENT CLAUSE

The Administrator of your personal data is Bema Studio Sp. z o.o. sp. k. with its registered office in Wrocław, 8a Sienkiewicza St., 50-335 Wrocław. The Administrator can be contacted via e-mail: iodo@bema-studio.com or by mail to the company’s address.

Your personal data will be used for the purposes of:
a) execution of the recruitment process – the legal basis for processing is the legitimate interest of the Administrator (Article 6(1)(f) of the GDPR), consisting of conducting and finalizing the recruitment process;
b) in the case of preference for employment based on an employment contract – in order to comply with legal obligations related to the recruitment process, including primarily the Labor Code – the legal basis for processing is the Administrator’s legal obligation (Article 6(1)(c) of the General Data Protection Regulation 2016/679 (GDPR) in connection with the provisions of the Labor Code); in order to carry out the recruitment process for data not required by law – the legal basis for processing is consent (Article 6(1)(a) of the GDPR);

c) for the purpose of preferring employment based on a civil contract – the legal basis for processing the data contained in your application documents is to take action prior to the conclusion of the contract (Article 6(1)(b) GDPR), and to the extent that you have also provided optional data – the legal basis for processing is consent (Article 6(1)(a) GDPR);
d) for the purposes of conducting future recruitment processes, where you have consented to the processing of data for these purposes – the legal basis for processing is consent (Article 6(1)(a) GDPR);
e) establishing or asserting potential claims or defending against such claims by the Administrator – the legal basis for data processing is the Administrator’s legitimate interest in asserting or defending against claims.

Your data may be transferred to entities that process personal data on behalf of the Administrator, including IT service providers.

Your personal data will be processed for the duration of the Administrator’s legitimate interest or, in the case of consent, until it is withdrawn. The period of personal data processing may be extended each time by the period of the statute of limitations for claims, if the processing of personal data is necessary for the Administrator to assert or defend against possible claims. 

To the extent that personal data is processed for marketing communications, for analytical and statistical purposes, and for marketing analysis, the data will be processed until you object to the processing for these purposes.

You have the right to access your data and the right to request their rectification, erasure or restriction of their processing. In addition, to the extent that the basis for the processing of your personal data is the premise of the Administrator’s legitimate interest, you have the right to object to the processing of your personal data. To the extent that the processing is based on your consent, you have the right to withdraw that consent.

Your personal data is not subject to profiling and automatic processing.

You have the right to lodge a complaint with the supervisory authority in charge of personal data protection in the Member State of your habitual residence, place of work or place where the alleged violation was committed. In Poland, the competent authority is the President of the Office for Personal Data Protection.


Provision of personal data is voluntary, but necessary to conclude a contract – excluding data marked as optional.
